4. Ordering and Payment

4.1. Order Acceptance: Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell.

4.2. Payment: We accept various payment methods to provide you with convenient options for your purchase. These may include:

b) For International Customers (including U.S. customers): You may be subject to import duties and taxes, which are levied once a shipment reaches your country. Additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country; you should contact your local customs office for further information.
c) General: You agree that you are solely responsible for all taxes, duties, and customs fees on any purchase as required by any country, state, territory, or any other governmental agency. Rings.com is not responsible for calculating, collecting, reporting, or remitting any tax, duty, or customs fee to any governmental agency outside of Canada unless specifically required by law.

5. Custom Orders

5.1. Custom-Designed Rings: For information regarding custom-designed rings, please refer to our Custom Order Policy. Custom orders are subject to specific terms, including non-refundable deposits and limited cancellation options.

5.2. Applicability: The terms outlined in our Custom Order Policy are in addition to these Terms and Conditions. In the event of any conflict between the Custom Order Policy and these Terms and Conditions regarding custom orders, the Custom Order Policy shall prevail.

6. Shipping and Returns

6.1. Shipping: We will make every effort to ship your order according to the estimated delivery times provided. However, we cannot guarantee exact delivery dates.

6.2. Returns: Please refer to our separate Return Policy for information on returns, exchanges, and refunds.

7. Intellectual Property

All content on this website, including text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is the property of Rings.com or its content suppliers and is protected by international copyright laws.

8. User Content and Custom Designs

8.1. General User Content: By posting, uploading, or submitting any content to our website (such as reviews, comments, or forum posts), you grant Rings.com a non-exclusive, royalty-free, perpetual, irrevocable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media for the purposes of operating and improving our services.

8.2. Custom Design Submissions: For custom jewelry design requests, including but not limited to sketches, descriptions, or other design materials:

a) By submitting your design ideas or concepts to Rings.com, you acknowledge and agree that Rings.com will own all rights, title, and interest in the final design and the resulting jewelry piece.
b) You grant Rings.com the right to use, reproduce, modify, adapt, and create derivative works based on your submitted design ideas or concepts for the purpose of creating the custom piece and for any other purpose, including but not limited to marketing, portfolio display, and creating similar designs for other customers.
c) While Rings.com will own the rights to the final design, we respect the collaborative nature of the custom design process. We may, at our discretion, offer you the right of first refusal before creating similar designs for other customers.
d) Rings.com may showcase the final product in our portfolio or marketing materials without seeking additional approval.

8.3. Representations and Warranties: You represent and warrant that you have the necessary rights to grant Rings.com the ownership and rights described in this section, and that your submission does not infringe on any third-party intellectual property rights.

8.4. Compensation: Unless explicitly agreed upon in writing, you will not receive any compensation or royalties for Rings.com's use or ownership of designs based on your submissions.

9. User Conduct

You agree not to use our website for any unlawful purpose or in any way that interrupts, damages, or impairs the site's functionality. Prohibited activities include, but are not limited to:

  • Harassing, threatening, or abusing other users
  • Impersonating any person or entity
  • Submitting false or misleading information
  • Attempting to gain unauthorized access to our systems

10. Disclaimer of Warranties

Rings.com provides its website and services "as is" and "as available" without any warranty or condition, express, implied, or statutory.

11. Limitation of Liability

In no event shall Rings.com be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

12. Indemnification

You agree to indemnify, defend, and hold harmless Rings.com from any claim, demand, damages, or other losses, including reasonable attorneys' fees, asserted by any third-party resulting from or arising out of your use of our website or services, or any violation of these Terms.

13. Governing Law and Jurisdiction

13.1. For Canadian Customers: These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located within British Columbia for the purpose of litigating all such claims or disputes.

13.2. For International Customers (including US customers):

a) These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.
b) Any dispute arising out of or related to these Terms or any purchase from Rings.com shall be resolved through binding arbitration in Vancouver, British Columbia, in accordance with the rules of the British Columbia International Commercial Arbitration Centre.
c) Notwithstanding the foregoing, Rings.com reserves the right to bring a claim in your jurisdiction of residence where necessary to protect its intellectual property rights or to seek injunctive relief.

13.3. United Nations Convention: The United Nations Convention on Contracts for the International Sale of Goods will not apply to these Terms.

13.4. Class Action Waiver: To the extent permitted by applicable law, you agree to waive any right to participate in a class action lawsuit or class-wide arbitration against Rings.com.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.
